Terms of Service

These Terms of Service ("Terms") govern your use of DynamicQ ("the Platform"), operated by Yahya Dynamic (ABN 40 365 504 162) ("we", "us", "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Service Description
DynamicQ is an AI-powered education platform that generates differentiated worksheets, lesson resources, tests, and learning materials aligned to the NSW curriculum. The Platform provides tools for teachers, schools, students, and homeschool families to create and access educational content.
2. Account Types
The Platform offers the following account types:
- Teacher (Free Tier): Limited access to worksheet generation features.
- Teacher (Pro): Full access to all generation features, including anti-cheat modes, test generation, and daily lesson packs.
- School Licence: Multi-teacher access with administrative features and reporting.
- Student Pass: Access to homework help and guided learning features.
- HomeQ: Access for homeschool families with portfolio and compliance features.
3. Eligibility
You must be at least 18 years of age to create a teacher or parent account. Student accounts may be created by teachers or parents for students under 18. Students under 13 access the Platform using a username and PIN only โ no email address or personal information is required or collected.
4. Acceptable Use
You agree to use the Platform only for lawful educational purposes. You must not:
- Share your login credentials with unauthorised persons.
- Attempt to reverse-engineer, decompile, or extract source code from the Platform.
- Use the Platform to generate content that is offensive, discriminatory, or harmful.
- Resell, redistribute, or commercially exploit generated content outside your own teaching practice without our written consent.
- Attempt to overload, disrupt, or interfere with the Platform's infrastructure.
- Use automated tools, bots, or scripts to access the Platform without authorisation.
5. Payment Terms
Paid subscriptions are processed through Stripe. We do not store your credit card information โ all payment data is handled by Stripe in accordance with PCI-DSS standards.
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- You may cancel your subscription at any time. Access continues until the end of the current billing period.
- Refunds are available within 14 days of purchase if you have not generated more than 10 resources. Contact [email protected] for refund requests.
- Prices are in Australian Dollars (AUD) and include GST where applicable.
- School licence payments may be made by invoice with 30-day payment terms.
6. Intellectual Property
Content You Generate
Worksheets, tests, lesson resources, and other educational materials you generate using the Platform belong to you. You may use, print, distribute, and modify generated content for your own educational purposes without restriction.
Platform Intellectual Property
The Platform itself โ including its software, algorithms, design, branding, and underlying curriculum mapping โ is our intellectual property and is protected by Australian copyright law. You may not copy, reproduce, or create derivative works of the Platform.
Curriculum References
NSW syllabus outcome codes and descriptors referenced in generated content are the intellectual property of the NSW Education Standards Authority (NESA) and are used for educational alignment purposes.
7. AI-Generated Content Disclaimer
Some content generated by the Platform uses artificial intelligence. While mathematical and computational content is verified by symbolic mathematics software (SymPy), content in subjects such as English, History, and other humanities is AI-generated and should be reviewed by a qualified teacher before classroom use. We do not guarantee the accuracy of AI-generated content in non-computational subjects.
8. Limitation of Liability
To the maximum extent permitted by Australian law:
- The Platform is provided "as is" without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
- Our total liability to you for any claim arising from these Terms or your use of the Platform is limited to the amount you have paid us in the 12 months preceding the claim.
- We are not liable for any loss arising from service interruptions, data loss, or technical failures.
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited by agreement.
9. Termination
- You may close your account at any time by contacting [email protected].
- We may suspend or terminate your account if you breach these Terms, with or without notice.
- Upon termination, your right to access the Platform ceases immediately. Generated content you have already downloaded remains yours.
- We will delete your personal data within 30 days of account closure, in accordance with our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be resolved in the courts of New South Wales.
